These terms and conditions apply to the use of the platform Snow Studio's Dispatch (the "Service"), an online dispatch and CAD system for game communities, offered by Snow Studio's ("we", "us" or "Snow Studio's"). By creating an account or using the Service you agree to these terms.
1. Definitions
- Account: the personal user account that gives you access to the Service.
- Community (organisation): an isolated environment within the Service, managed by an owner, in which members work together.
- Admin: a user with the owner or admin role within a Community.
- Subscription: a paid plan that unlocks (additional) functionality of the Service.
- User: any natural person who holds an Account or uses the Service.
2. Applicability
These terms apply to every agreement and every use of the Service. Deviations apply only where we have confirmed them in writing. We may amend these terms; the most current version is always published on the main domain. We will inform you in advance of material changes.
3. Account and registration
- You must be at least 16 years old, or have permission from a parent or guardian, to create an Account.
- You provide accurate and complete information and keep it up to date.
- You are responsible for keeping your login details confidential and for all activity under your Account.
- Access to a Community is granted by invitation or by a join request that an Admin of that Community must approve.
4. Use of the Service
Every Community is an environment isolated from other Communities. An owner decides who has access and which role (owner, admin, dispatcher, unit or member) a user receives. You use the Service solely for legitimate purposes within the context of a game community.
5. Acceptable use
You may not:
- use the Service in breach of laws or regulations or the rights of others;
- post unlawful, abusive, discriminatory or otherwise harmful content;
- circumvent, disrupt or overload the security or technical operation of the Service;
- access data of other Communities or users beyond what you are entitled to;
- use the Service for spam, deception or automated abuse;
- share your API key for integrations (such as the Roblox integration) or use it outside your own Community. You are responsible for keeping the key confidential and for the (game) server you connect.
In the event of (suspected) abuse we may restrict, suspend or terminate access to the Service.
6. Subscriptions, prices and payment
The Service may contain both free functionality and paid Subscriptions. For paid Subscriptions the following also applies:
- Prices are stated in euros. For business customers prices are shown excluding VAT unless stated otherwise; for consumers including VAT. For consumers in other EU member states, VAT is charged at the rate of your country of residence.
- Payment is made in advance and periodically (monthly or annually) through the payment methods offered. Payment is processed by an external payment provider.
- A Subscription renews automatically for the same period unless you cancel before the end of the current period.
- We may change prices and the contents of plans. We announce price changes for a running Subscription at least 30 days in advance; you may cancel with effect from the date the change takes effect.
- If payment is not made on time we may suspend access to paid functionality.
- Amounts already paid for a current period are not refunded, unless mandatory law provides otherwise.
Consumers in the EU have a statutory 14-day right of withdrawal. Because the Service is supplied digitally and immediately, this right lapses once delivery has begun with your express consent.
7. Term and cancellation
You can terminate your Account or a Community at any time from the settings. Cancellation of a paid Subscription takes effect at the end of the current billing period. On termination, data may be permanently deleted after a reasonable period.
8. Availability and maintenance
We make every effort to keep the Service available and reliable, but we do not guarantee uninterrupted availability. We may take the Service offline temporarily for maintenance, updates or security.
9. Intellectual property
All intellectual property rights in the Service, including the software, design and the Snow Studio's brand, belong to Snow Studio's or its licensors. Content that users create within a Community remains theirs or the Community's; you grant us a limited right of use to the extent necessary to provide the Service.
10. Liability
The Service is provided "as is". To the extent permitted by law, our liability is limited to direct damages and to a maximum of the amount you paid for the Service in the 12 months preceding the event causing the damage. We are not liable for indirect damages, consequential loss or loss of data, except in cases of intent or wilful recklessness.
11. Personal data
We process personal data in accordance with our privacy statement and applicable legislation (GDPR).
12. Changes to the Service
We may further develop, adjust or discontinue the Service and its functionality. We will inform you of material changes that affect your use.
13. Governing law and disputes
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise. Nothing in this clause deprives a consumer of the protection of mandatory provisions of the law of their country of residence.
